Acceptance of Terms

The tennis lesson reservation services provided by JJYE Services LLC, doing business as The Racquet (“The Racquet”), are governed by the foregoing Terms of Use (“TOU”). The Racquet reserves the right to update and modify the TOU at any time without prior notice to you. The most current version of the TOU can be reviewed by accessing the “Terms of Use” link typically located at the bottom of our website pages.

When updates are made to the TOU, The Racquet will amend the effective date at the top of the TOU page. Your continued use of The Racquet's services, including tennis lesson reservations, after any such updates signifies your acceptance of the revised TOU. It is your responsibility to regularly review the TOU to stay informed of any changes. By reserving a tennis lesson and utilizing The Racquet's services post any updates to the TOU, you agree to abide by and be bound by the terms of the updated version of the TOU.

Description of Services

Through its various platforms and facilities, The Racquet offers you access to a range of services tailored to racquet sports training. These services include, but are not limited to, professional coaching in tennis, paddle tennis, and pickleball, personalized training programs, skill drills, strategic lessons, match play opportunities, fitness conditioning specifically designed for racquet sports, and access to training facilities and equipment (collectively “Services”).

Scope of Services

The Racquet offers comprehensive training services in tennis, paddle tennis, and pickleball. These services encompass a variety of activities including skill drills, strategy development, match play, and fitness conditioning specifically tailored for racquet sports.

Session Duration

Each training session provided by The Racquet will have a standard duration of sixty (60) minutes.

Program Development

Training programs are customized for each client, taking into account their individual skill levels, physical condition, and personal training objectives. The Racquet commits to designing a program that best suits the needs and goals of the client.

Coach Assignment

Clients will be assigned a qualified coach from The Racquet's team. The assigned coach may be subject to change at The Racquet's discretion, based on factors such as coach availability, expertise alignment with client needs, or other relevant considerations.

Client Obligations

To ensure a safe and effective training experience, clients are required to: (1) Sign an Informed Consent and Release of Liability form prior to commencing their training program; and (2) Inform The Racquet of any physical conditions, medical history, or other factors that may impact their ability to safely participate in the training program.

Acceptance of Terms of Future Services

By accepting these Terms and Conditions, clients agree that these terms will apply to all future lessons and services with The Racquet. Clients understand that:

  • Continued Agreement: The acceptance of these Terms and Conditions signifies consent to these terms for all future services provided by The Racquet, unless and until the client requests a change.
  • Modification of Terms: Should clients wish to modify or update any agreed-upon terms, they must submit a written request at least 48 hours before the scheduled lesson. Any requested changes are subject to approval by The Racquet and will only take effect after confirmation.
  • Confirmation of Terms: The current Terms and Conditions, along with any additional forms, are available via confirmation links sent to clients. Clients are encouraged to review these documents before each lesson to stay informed of any updates.

Session Scheduling and Location

Training sessions will be scheduled at times and locations mutually agreed upon by The Racquet and the client. The Racquet endeavors to accommodate the client’s scheduling preferences to the best of its ability, subject to the availability of coaches and training facilities.

Payment Terms

The cost of training sessions at The Racquet is determined based on the specific lesson package selected by the Client through The Racquet’s website or mobile application. The price for each training session is as per the package chosen by the Client. The detailed pricing for each available package can be found on The Racquet's website or mobile application.

In addition to the base price of the training package, Clients may opt for additional services or add-ons, the costs of which will be clearly stated during the selection process on the website or app.

Pending Charges

To ensure a smooth and consistent payment process, The Racquet reserves the right to charge any pending fees for services rendered if payment has not been completed within 72 hours of the scheduled service. By using The Racquet’s services, clients agree to the following:

  • Payment Timing: All payments must be made in full prior to each lesson or service.
  • Delayed Payment Handling: If payment is not received within 72 hours after the scheduled lesson or service, The Racquet reserves the right to charge the pending amount to the credit card on file or any other provided payment method.
  • Authorization: By agreeing to these terms, clients authorize The Racquet to process any outstanding payments through the designated payment method after the 72-hour window.


Short-Notice Cancellation and No-Show Terms

Cancellation Fees:

  • 48 Hours Notice: If a cancellation is made less than 48 hours before the scheduled lesson time, a cancellation fee of 50% of the lesson cost will apply.
  • 24 Hours Notice: If a cancellation is made less than 24 hours in advance, the full cost of the lesson will be charged.
  • Semi-Private Lessons and Meet-Ups:

    • Cancellation Charge: For confirmed spots, if a cancellation is made less than 48 hours in advance, the full charge will apply.
    • Spot Reservation: We will reserve spots for semi-private lessons and meet-ups, but they will only be fully confirmed upon receipt of payment.
  • Weather-Related Cancellations

    No Charges for Immediate Cancellations:

    • Weather Impact: If weather conditions necessitate the cancellation of a lesson right before it is due to start, there will be no charges applied. We recognize that weather is unpredictable, and we strive to be fair in such circumstances.

    Handling Partially Completed Lessons:

    • Less than 15 Minutes: If a lesson is started but is cancelled by weather conditions within the first 15 minutes, there will be no charge for the lesson.
    • More than 15 Minutes: If we have been playing for more than 15 minutes when the lesson is cancelled due to weather, the lesson will be charged at the regular rate. However, the time not utilized due to the early termination will be credited and added to your next scheduled lesson.

Assumption of Risk Acknowledgment

The Client must acknowledge and agree to the Assumption of Risk, which outlines the inherent risks and dangers associated with participation in racquet sports training. This includes, but is not limited to, the risk of accidents, injury, physical exertion, and other potential harm or loss.

Waiver of Liability Agreement

The Client must also agree to the Waiver of Liability, releasing The Racquet and its affiliates, officers, directors, employees, coaches, and agents from any liability, claims, demands, actions, and causes of action related to any loss, damage, injury, or death sustained while participating in the training program or using The Racquet's facilities and equipment.

Health and Safety Acknowledgment

By agreeing to these TOU, the Client declares that they are physically fit and not aware of any medical condition that would impede their full participation in The Racquet's racquet sports training program.

The Client agrees to the responsibility of promptly The Racquet of any significant injuries or changes in their medical condition that occur. This includes any health issues that could potentially affect their ability to participate safely in the training.

Facility and Equipment Use

The Client is expressly prohibited from misusing or abusing The Racquet’s facilities and equipment. Misuse or abuse is defined as any action that poses a safety risk to themselves or others, or results in damage or undue wear and tear to the facilities or equipment.

In the event of any damage caused by the Client’s misuse or abuse of The Racquet’s facilities or equipment, the Client will be held responsible. This responsibility includes financial accountability for repairing or replacing damaged property, as well as any potential liability for harm caused to others due to such actions.

Consent for Image and Likeness

The Racquet reserves the right to use these photographs and video recordings for various business-related purposes. This includes, but is not limited to, promotional activities, instructional content creation, and other legitimate business uses.

By agreeing to these TOU, the Client provides consent for The Racquet to use their image, likeness, and performance captured in such media. This consent is given without the expectation of compensation or any further consent for each specific use.
